INTRODUCTION

ACCELER TECHNOLOGY — EBC TA STAMPING SERVICE

These Terms and Conditions ("Terms") govern your access to and use of the EBC TA Stamping service and related features (the "Service") provided by ACCELER TECHNOLOGY (“ACCELER”, “we”, “us” or “our”), a business located at Bandar Bukit Tinggi 2, Klang, 41200, Selangor, Malaysia. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. DEFINITIONS

1.1. “User”, “you” or “your” means any individual or entity that registers for, accesses, or uses the Service.
1.2. “EBC TA Stamping” or “EBC” means Acceler Technology’s Estate Boost Copilot tenancy agreement stamping automation product.
1.3. “LHDN” means Lembaga Hasil Dalam Negeri Malaysia (Inland Revenue Board of Malaysia).
1.4. “Sijil” means the stamped tenancy agreement certificate (PDF) returned by LHDN after successful stamping.
1.5. “Stamping Fee” means the government/official fee required by LHDN for tenancy agreement stamping, as determined by LHDN at the time of application.
1.6. “Service Fee” means the fee charged by ACCELER for providing the EBC TA Stamping automation and application assistance (currently RM10 per application).
1.7. “Edit Service Fee” means the fee charged to process a user-initiated modification after submission (currently RM20 per modification request).
1.8. “Payment Processor” means third-party payment providers we integrate (currently Billplz, using FPX).
1.9. “Account” means your registered user account on our platform.

2. SCOPE OF SERVICE

2.1. The Service uses an AI-assisted workflow to extract relevant information from tenancy agreements uploaded by Users, pre-fill application data, and assist Users to submit tenancy agreement stamping applications to LHDN.
2.2. We provide a fee calculator and pricing information on our website so Users may estimate the Stamping Fee (per LHDN tariff) and the Service Fee prior to submission. The Stamping Fee charged on each application will follow LHDN’s fee schedule as at the time of submission. See LHDN for further details on stamp duty and applicable tariffs. Hasil
2.3. After successful LHDN stamping, LHDN issues a Sijil (PDF) which we will deliver to the User via the User’s account. We store each submitted application, uploaded tenancy agreement PDF, and Sijil in the User’s account for retrieval.

3. USER ELIGIBILITY; ACCOUNT REGISTRATION

3.1. By registering, you represent and warrant that you are at least eighteen (18) years old and have the legal capacity to enter contracts. (Malaysia’s age of majority is eighteen (18) years). jc-law.my
3.2. Account registration requires a valid email address (or Google OAuth), password (if applicable), and other profile information (name, phone number, country, age, gender). You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your Account.
3.3. You must provide accurate, complete and lawful information for every application. You must have the authority and/or consent to submit any tenancy agreement on behalf of the parties identified in the document.

4. FEES, PAYMENT AND BILLING

4.1. Fees: Each submission to the Service is charged as follows: (a) Stamping Fee — charged in accordance with LHDN’s tariff; and (b) Service Fee — RM10 per application (current). The Edit Service Fee for post-submission modification requests is RM20 per request (current).
4.2. Payment Processing: All payments are processed by our Payment Processor (Billplz using FPX). By submitting payment you authorize Billplz and the applicable banking/FPX network to process the transaction. ACCELER is not the payment processor and is not responsible for Billplz or bank outages or delays in payment settlement. See Billplz for specific payment service terms. main.billplz.com +1
4.3. Stamping Fee collection and remittance: When we collect Stamping Fees, we collect those fees in order to complete your LHDN application and remit or apply them as required to obtain stamping. The Stamping Fee amount on the fee calculator reflects LHDN’s tariff at the time of display but is subject to change by LHDN.
4.4. Taxes and duties: All fees are exclusive of any taxes, duties, or government charges unless expressly stated. Users are responsible for any taxes imposed on their use of the Service.

5. NO REFUNDS (GENERAL) AND DATA-LOSS REMEDIATION (LIMITED EXCEPTION)

5.1. General No-Refund Policy: Except as expressly provided in Section 5.2 below, all fees payable are non-refundable once payment is made and the application has been submitted.
5.2. Data-Loss Remediation: If you have paid for an application and ACCELER (or our systems under our control) loses your submitted data or the uploaded tenancy agreement such that the application cannot be completed through no fault of you or third-parties outside our control, ACCELER will take reasonable steps to remediate. This includes re-performing the application process and, where necessary, covering the LHDN Stamping Fee using the amounts already paid (i.e., we will apply the previously paid amounts toward the remedial submission and we will work, at our cost, to obtain the Sijil). This remedial measure applies only to post-payment data loss events caused by ACCELER or our service providers; it does not apply where the loss is caused by the User (for example, if the User uploaded incorrect documents) or by LHDN or Billplz. Any remedial action is subject to LHDN’s acceptance and processes.
5.3. Where we cannot reasonably remediate a post-payment data loss, we will work with you in good faith to provide an appropriate remedy (such as reattempt, credit toward future services, or other reasonable solutions). We do not guarantee cash refunds.

6. USER RESPONSIBILITIES, VERIFICATION AND WARRANTIES

6.1. Accuracy and completeness: You are solely responsible for the accuracy, completeness, legality and suitability of the documents and information you upload and confirm in the final review step (“Edit Form — Confirm — Submit”). You must carefully verify all extracted and pre-filled information prior to submission.
6.2. Authority and consent: You represent and warrant that you have the legal right, power and authority to submit any tenancy agreement and to authorize ACCELER to act on your behalf for the purposes of the LHDN stamping application.
6.3. Signatures and legal compliance: You are responsible for obtaining all necessary signatures and ensuring that the tenancy agreement complies with applicable laws and LHDN requirements. ACCELER does not provide legal advice; our AI assistance is an automation tool only.

7. AI ASSISTANCE; DISCLAIMER OF WARRANTIES

7.1. AI-Assisted Tool: The Service uses AI to extract information from uploaded tenancy agreements. The AI may make errors, omissions or misinterpretations. The AI result is an assistive output only — it is not a substitute for human review or legal advice.
7.2. “AS IS” and NO WARRANTY: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. ACCELERER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING (WITHOUT LIMITATION) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. You are solely responsible for reviewing the application content before submission to LHDN.

8. STORAGE, PRIVACY AND DATA CONTROLS

8.1. Data storage: Uploaded documents, application data and issued Sijil PDFs will be stored in your Account and on third-party data center(s) used by ACCELER. By using the Service you consent to such storage and processing.
8.2. Privacy: Our collection and processing of personal data is described in our Privacy Policy. You should review that policy to understand how your information is used, stored, shared and to learn your rights relating to data access, correction and deletion. (Privacy Policy is available on our website.)
8.3. Security: We maintain commercially reasonable technical and organizational measures to protect data; however no system is entirely immune from risks. See Section 5 for our remedies when post-payment data loss is caused by our systems.

9. INTELLECTUAL PROPERTY

9.1. Ownership: All platform content (including code, UI, images, text, models, workflows and documentation) and any improvements thereto are the exclusive property of ACCELER or our licensors.
9.2. Restrictions: You may not copy, reproduce, distribute, create derivative works from, sublicense, or commercially exploit our code, images, designs or any platform content except as expressly permitted in writing by ACCELER. You may reference or quote content only with proper attribution to ACCELER and by prior written consent where required. 9.3. User content license: By uploading documents and content to the Service, you grant ACCELER a non-exclusive, worldwide, royalty-free license to use, store, transmit and process such content solely for the purpose of providing the Service and complying with LHDN submission procedures.

10. PROHIBITED USES AND ABUSE POLICY

10.1. Prohibited Conduct includes, but is not limited to: a) Uploading files or content unrelated to LHDN tenancy agreement stamping for malicious or disruptive purposes; b) Repeatedly initiating uploads or automated submissions without paying the required fees (payment evasion or abuse); c) Using bots, scrapers or automated tools to repeatedly call the Service or extract platform content (if you require automation, request our API and a licensing agreement); d) Attempting to overload, probe, penetrate, attack or otherwise interfere with the Service’s infrastructure; e) Uploading or transmitting content that is unlawful, fraudulent, defamatory, or that violates third-party rights.
10.2. Enforcement: We reserve the right to suspend or terminate Accounts, block access to the Service, and pursue any available remedies (including legal action and cooperation with LHDN authorities) where we identify prohibited conduct. Users engaged in severe or repeated violations may be permanently banned.

11. SERVICE AVAILABILITY, OUTAGES AND MAINTENANCE

11.1. Service window notice: If we detect or experience a disruption in the Service chain that affects availability (including third-party provider outages), we may display a notice in the EBC TA Stamping window explaining the issue, expected impact, and whether the submission window is paused.
11.2. LHDN outages: If LHDN’s website or systems are unavailable, we will generally keep the Service open for Users to prepare applications and will wait to proceed with submissions until LHDN is available, or we will otherwise notify Users of the appropriate next steps. ACCELER is not liable for delays caused by LHDN.
11.3. In-process submissions: For submissions that have been uploaded and paid prior to an outage, ACCELER will use commercially reasonable efforts to complete the process and obtain the Sijil once the chain is restored. See Section 5 (Data-Loss Remediation) for the remedy where ACCELER is at fault for data loss.

12. MODIFICATIONS AFTER SUBMISSION

12.1. Edit requests: If you require changes after submission, contact our edit support at +60 11-6966 0178 (only Whatsapp) (Edit requests) or estateboostcopilot@gmail.com. An Edit Service Fee of RM20 applies per modification request. Such changes are not guaranteed and remain subject to LHDN acceptance and any additional LHDN rules or fees.
12.2. Non-guarantee: ACCELER does not guarantee that LHDN will accept or process post-submission changes.

13. TERMINATION; SUSPENSION; SURVIVAL

13.1. We may suspend or terminate your Account and access to the Service for breach of these Terms or for any lawful reason with notice where practicable. Termination does not relieve you of any payment obligations incurred prior to termination.
13.2. Surviving provisions: Clauses concerning Fees (to the extent unpaid), Intellectual Property, Indemnity, Limitation of Liability, Governing Law and Dispute Resolution, and other provisions reasonably intended to survive termination shall survive.

14. INDEMNIFICATION

14.1. You agree to indemnify, defend and hold harmless ACCELER and its officers, directors, employees and contractors from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with: (a) your breach of these Terms; (b) your submission of inaccurate or illegal documents or data; or (c) your misuse of the Service.

15. LIMITATION OF LIABILITY

15.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCELER’S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY YOU FOR THE AFFECTED APPLICATION (OR, IF APPLICABLE, THE FEES PAID FOR THE PRIOR TWELVE (12) MONTHS). IN NO EVENT SHALL ACCELER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES).
15.2. EXCEPTIONS: Nothing in this Section limits liability to the extent that liability cannot be limited under applicable law.

16. GOVERNING LAW; ARBITRATION (DISPUTE RESOLUTION)

16.1. Governing law: These Terms are governed by and construed in accordance with the laws of Malaysia.
16.2. Arbitration: Any dispute, controversy or claim arising out of or relating to these Terms (including their existence, validity, interpretation, performance, breach or termination) shall be referred to and finally resolved by arbitration in Kuala Lumpur, Malaysia in accordance with the rules of the Asian International Arbitration Centre (AIAC) (or its successor rules) and the Malaysian Arbitration Act 2005, as applicable. The seat of arbitration shall be Kuala Lumpur unless otherwise agreed. The arbitration shall be conducted in English. The Parties submit to the exclusive arbitral procedure and award enforcement under Malaysian law.

17. CHANGES TO THESE TERMS

17.1. We may modify these Terms from time to time. Where changes are material, we will use reasonable efforts to notify you (via email or in-platform notice). Continued use of the Service following notice of changes constitutes acceptance of the updated Terms.

18. MISCELLANEOUS

18.1. Entire agreement: These Terms constitute the entire agreement between you and ACCELER regarding the Service, superseding prior communications.
18.2. Severability: If any provision of these Terms is found unenforceable, the remainder of the Terms will remain in effect.
18.3. No waiver: Our failure to enforce any right is not a waiver of that right.

APPENDIX A — USER GUIDELINES (EBC - TA STAMPING)

By checking the box on our site and proceeding with a submission you acknowledge and agree to the following User Guidelines, which form part of these Terms.
A.1 About the Service
• The EBC TA Stamping service uses AI to assist Users in extracting information from tenancy agreements to accelerate the LHDN stamping application. The Service is an assistive automation tool only.
A.2 AI accuracy and user verification
• The AI may make mistakes. You must carefully check and verify all extracted fields and the final application content before confirming and submitting. The final responsibility for accuracy rests with you.
A.3 User responsibilities (summary)
• You are fully responsible for the correctness, legality and completeness of uploaded documents and submitted information.
• Ensure uploaded tenancy agreements match what you confirm in the Edit Form — Confirm — Submit step. Discrepancies are your responsibility.
• If incorrect information leads to rework, the Edit Service Fee (RM20) applies; not all changes are guaranteed to be accepted by LHDN.
A.4 Fees and edits

• Stamping Fee is charged per LHDN tariff and shown on the fee calculator. No refunds (see Section 5 for limited post-payment remediation).
A.5 Prohibited / “violent” behaviors (examples)
• Repeatedly initiating submissions and refusing to pay; malicious or irrelevant file uploads intended to disrupt the Service; low-relevance uploads (where document content does not correspond to the application content); bulk uploads designed to consume platform resources; use of bots/scrapers to access the Service (request an API instead).
• Illegal purposes or uses inconsistent with LHDN rules.
A.6 Enforcement
• Users found to be engaging in the prohibited behaviors may be permanently blocked and banned from ACCELER services. We will cooperate with LHDN and authorities to counter malicious or illegal activity.
A.7 Support and service disruptions
• If our Service chain has problems, we will display a notice and—depending on the nature of the issue—temporarily suspend the EBC TA Stamping window. For in-process, paid submissions, we will use commercially reasonable efforts to complete and deliver the Sijil. If the problem stems from LHDN, we will wait for LHDN to resolve the issue. If the problem stems from our third-party providers, we will decide whether to suspend the Service and will notify Users.
